การฟ้องคดีอาญาประธานาธิบดีในขณะที่ดำรงตำแหน่ง

Abstract

บทความนี้จะได้พิจารณาถึงคำถามที่ว่าประธานาธิบดีซึ่งอยู่ในตำแหน่งสามารถที่จะถูกฟ้องร้องในคดีอาญาได้หรือไม่ ในการตอบคำถามนี้ผู้เขียนได้พิจารณาจากตัวบทของรัฐธรรมนูญแห่งสหรัฐอเมริกาและการตู้เย็นกันในทางความคิดเห็นซึ่งปรากฏอยู่ในเอกสารการร่างและการให้สัตยาบันรัฐธรรมนูญดังกล่าว ประการที่ 2 ผู้เขียนได้พิจารณาจากคำพิพากษาของศาลที่เกี่ยวข้องในประเด็นนี้ รายการที่ 3 ผู้เขียนได้วิเคราะห์ถึงเอกสารของกระทรวงยุติธรรมสหรัฐอเมริกาและอัยการสูงสุดของสหรัฐซึ่งปฏิบัติหน้าที่อยู่โดยได้แสดงความเห็นเกี่ยวกับความเป็นไปได้ในการฟ้องร้องประธานาธิบดี และประการสุดท้ายผู้เขียนได้คำนึงถึงข้อพิจารณาในทางปฏิบัติเกี่ยวกับการฟ้องร้องประธานธิบดีซึ่งกำลังดำรงต าแหน่งอยู่ ผู้เขียนพบว่าไม่มีแนวทางปฏิบัติหรือแนวคำพิพากษาหรือกฎหมายใดๆที่ห้ามการฟ้องคดีอาญาดังกล่าวการฟ้องคดีเช่นว่านั้นอาจจะสามารถทำได้ด้วยความระมัดระวังในสถานการณ์ที่เหมาะสม

This article addresses the question of whether a sitting U.S. president may be chargedwith a crime while in office. In examining this question, the author first considers the text of the Unites States Constitution and the debates surrounding its drafting and ratification. Second, the author examines relevant court decisions regarding this question. Third, the author analyzes memoranda prepared by the United States Department of Justice’s Office of Legal Counsel, as well asother government attorneys acting in anofficial capacity, who have opined aboutthe possibility of indicting the president. Finally, the author addresses practical considerationsregarding theindictment of a sitting president.
