    กฎหมายลิขสิทธิ์ไทยเปิดโอกาสให้ศาลสร้างข้อยกเว้นการละเมิดลิขสิทธิ์ใหม่หรือไม่
    ในบทความนี้ ผู้เขียนพยายามหาคำตอบว่าพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 (ตามที่แก้ไขแล้ว) เปิดโอกาสให้ศาลสร้างข้อยกเว้นการละเมิดลิขสิทธิ์ใหม่หรือไม่ โดยเน้นพิจารณามาตรา 32 แห่งพระราชบัญญัติดังกล่าว เพื่อให้การพิจารณาข้างต้นครอบคลุมมากขึ้น ผู้เขียนอ้างอิงโดยสังเขปถึงเงื่อนไขสามประการของข้อยกเว้นการละเมิดลิขสิทธิ์ที่ Berne Convention (Paris Act, 1971), Article 9 (2) และ TRIPS Agreement, Article 13 ได้กำหนดไว้ (หรือที่เรียกว่า “3-Step Test”) ด้วยทั้งนี้ เพราะความตกลงระหว่างประเทศทั้งสองฉบับมีผลผูกพันประเทศไทย นอกจากนั้นแล้วด้วยเหตุที่ไม่มีแนวปฏิบัติว่าด้วยการปรับใช้เงื่อนไขตาม 3-Step Test ที่ผูกพันประเทศสมาชิกของ Berne Convention และ TRIPS Agreement ผู้เขียนจึงนำความเห็นของ WTO Panel on United States-Section 110 (5) of the US Copyright Act (WT/DS160/R, 15 June 2000) และคำอธิบายเกี่ยวกับ 3-Step Test มาประกอบการพิจารณาด้วย คำอธิบายดังกล่าวปรากฎใน A Handbook on the WTO TRIPS Agreement (2020) และ Guide to the Berne Convention for the Protection of Literary and Artistic Works (Paris Act, 1971) ผลของการพิเคราะห์ทำให้ผู้เขียนสรุปว่า พระราชบัญญัติลิขสิทธิ์ฯ ไม่เปิดโอกาสให้ศาลมีดุลยพินิจกว้าง ข้อสรุปนี้ทำให้ผู้เขียนเสนอว่า ตราบใดที่ยังไม่มีการแก้ไขพระราชบัญญัติลิขสิทธิ์ฯ หากมีข้อพิพาทเกิดขึ้น จำเลยควรตรวจสอบดูว่าจะอาศัยข้อยกเว้นหนึ่งข้อยกเว้นใดที่ปรากฎอย่างแจ้งชัดในกฎหมายได้หรือไม่

    The Deadlock of ASEAN Dispute Settlement Mechanisms and Why ASEAN Cannot Unlock It?
    The objective of this work is to answer the questions that “What is the deadlock of ASEAN Dispute Settlement Mechanisms (ASEAN DSMs)?” and “Why can’t ASEAN unlock it?” by comparative study between ASEAN DSMs and European Union Dispute Settlement Mechanisms (EU DSMs). A result of this work found that a positive consensus in decision making mode of ASEAN Summit under Article 20 of ASEAN Charter (Charter), which is seriously designed to protect the political security of ASEAN, also created a deadlock of ASEAN DSMs as a whole. Finally, in order to bypass this dead-end, the ASEAN needs to reverse the process by using the model of reverse consensus (negative consensus). However, even the Charter opens a gap to unlock its deadlock by re-interpreting of law, the ASEAN Summit still keep seriously staying on an ASEAN way to protect the political security. Hence the deadlock of ASEAN DSMs cannot be solved in practice until the political mindset of ASEAN is changed.

    บริบทหลักนิติธรรมในต่างประเทศ
    การวิจัยนี้รวบรวมหลักการต่าง ๆ ทั้งหลักนิติธรรม หลักนิติรัฐ และหลักธรรมาภิบาลในบริบทของต่างประเทศเพื่อวิเคราะห์ความเหมือนและความแตกต่าง รวมถึงศึกษาแนวคิดของหลักนิติธรรมในภาคเอกชน เพื่อสร้างองค์ความรู้เกี่ยวกับหลักการเหล่านี้โดยเน้นศึกษาในหลักนิติธรรมที่เป็นหลักของกลุ่มประเทศที่ใช้ระบบกฎหมายจารีตประเพณี (Common Law System) อันเป็นหลักที่จำกัดการใช้อำนาจของผู้ปกครองไม่ให้เกินขอบเขตโดยปกครองภายใต้กฎหมาย อีกทั้งได้เปรียบเทียบกับหลักนิติรัฐ (Legal State) ที่มาจากหลักกฎหมายของกลุ่มประเทศที่ใช้ระบบกฎหมายลายลักษณ์อักษร (Civil Law System) รวมถึงในการใช้หลักนิติธรรมกับแนวทางการบริหารกิจการบ้านเมืองที่ดีหรือหลักธรรมาภิบาล (Good Governance) ว่ามีความเหมือนหรือแตกต่างกันอย่างไร แล้วนำข้อมูลที่ได้มาศึกษาเปรียบเทียบความคล้ายคลึงและแตกต่างของหลักต่าง ๆ ตลอดจนศึกษาประวัติความเป็นมา และการนำหลักต่าง ๆ มาปรับใช้ในกฎหมายต่าง ๆ โดยเฉพาะมาตรา 3 วรรคสองของรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550

    INDONESIA & THAILAND: "MALTREATMENT" /"FORCED LABOR" /"TIP" IN FISHERIES IN INDONESIA /THAILAND
    This article focuses on “trafficking in persons” (TIP) in fisheries in Indonesia and Thailand which refers to key international instruments on TIP and continues by discussing recent cases of TIP in fisheries in Indonesia that were reported in the first half of year 2015. It also explores respective Indonesian and Thai domestic legislation in relation to measures to combat trafficking in the region. Bilateral and multilateral treaties such as the Treaty between the Government of the Kingdom of Thailand and the Government of the Republic of Indonesia Relating to Extradition and the ASEAN Treaty on Mutual Legal Assistance in Criminal Matters are also addressed as cooperation tools which should be used by Indonesia and Thailand in prosecuting traffickers. To attain success in prosecuting law breakers and to be fair to all concerned, the author discourages those who are preoccupied with TIP from prejudging all unlawful acts as incidents of TIP since many of them might not fall under the criteria of TIP. Additionally, the article addresses the U.S. Victims of Trafficking and Violence Protection Act of 2000, which classifies countries under one of the tiers stipulated therein. The author indirectly suggests that, via the Act, the U.S. puts pressure upon other countries to suppress TIP intensively and properly protect victims of TIP. Therefore, the author urges Indonesia and Thailand to take special care in handling incidents of TIP in fisheries.
