Abstract
It is acceptable known that a cornerstone of the limitations on and exceptions to copyright is indicated in the Berne three-step test under Article 9(2) of the Berne Convention, which is a crucial clause for the member states to incorporate into their domestic laws. Notwithstanding, there are some arguments regarding the unclearness of the language used in the three-step test of the Berne Convention, which induces an ambiguity and different interpretations amongst member states. Due to the rapid of technological change, this argument is being addressed much recently whether the term used in the three-step test can be effectively adopted in the digital world. This article found that some minor amendments to the language used in the three-step test are required to reflect the new technological environment. Eventually, the exceptions granted in Article 9(2) can be the mould for the member states and at the meanwhile can still maintain the balance of the interests between right holders and users in the digital environment.
เป็นที่ทราบกันดีว่า หลักเกี่ยวกับข้อจำกัดและข้อยกเว้นของลิขสิทธิ์นั้น มีการระบุไว้ภายใต้เงื่อนไข 3 ประการ ที่เรียนกว่า Three-step test หรือที่รู้จักกันในนาม หลักบันไดสามขั้นที่ปรากฏอยู่ในมาตรา 9 (2) ของอนุสัญญากรุงเบิร์น (Berne Convention) ซึ่งเป็นมาตราสำคัญที่ประเทศภาคีสมาชิกจะต้องผนากรวมเข้าไว้ในกฎหมายภายในประเทศของตน อย่างไรก็ดียังมีข้อโต้แย้งเกี่ยวกับความไม่ชัดเจนของภาษาที่ใช้ในหลักบันไดสามขั้น ซึ่งนำไปสู่การตีความที่แตกต่างกันระหว่างประเทศภาคีสมาชิก นอกจากนี้ ด้วยความรวดเร็วของการเปลี่ยนแปลงทางเทคโนโลยี ข้อโต้แย้งดังกล่าวทำให้เกิดคำถามตามมาว่า คำที่ใช้ในหลักบันไดสามขั้นนั้นสามารถที่จะนำมาปรับใช้อย่างประสิทธิผลในโลกดิจิทัลได้หรือไม่ ผู้เขียนเห็นว่าเป็นการดีและจำเป็นในการแก้ไขภาษาที่ใช้ในหลักบันไดสามขั้นบางส่วน เพื่อให้สามารถตอบสนองต่อการเปลี่ยนแปลงดังกล่าวได้เป็นอย่างดี ในที่สุดข้อยกเว้นการละเมิดลิขสิทธิ์ที่บัญญัติไว้ในมาตรา 9 (2) สามารถจะเป็นต้นแบบให้กับประเทศภาคีสมาชิก ในเวลาเดียวกัน ก็ยังคงรักษาความสมดุลระหว่างสิทธิประโยชน์ของผู้ทรงสิทธิและผู้ใช้ ในสภาพแวดล้อมที่เป็นดิจิทัลได้
