บริบทหลักนิติธรรมในต่างประเทศ

Abstract

การวิจัยนี้รวบรวมหลักการต่าง ๆ ทั้งหลักนิติธรรม หลักนิติรัฐ และหลักธรรมาภิบาลในบริบทของต่างประเทศเพื่อวิเคราะห์ความเหมือนและความแตกต่าง รวมถึงศึกษาแนวคิดของหลักนิติธรรมในภาคเอกชน เพื่อสร้างองค์ความรู้เกี่ยวกับหลักการเหล่านี้โดยเน้นศึกษาในหลักนิติธรรมที่เป็นหลักของกลุ่มประเทศที่ใช้ระบบกฎหมายจารีตประเพณี (Common Law System) อันเป็นหลักที่จำกัดการใช้อำนาจของผู้ปกครองไม่ให้เกินขอบเขตโดยปกครองภายใต้กฎหมาย อีกทั้งได้เปรียบเทียบกับหลักนิติรัฐ (Legal State) ที่มาจากหลักกฎหมายของกลุ่มประเทศที่ใช้ระบบกฎหมายลายลักษณ์อักษร (Civil Law System) รวมถึงในการใช้หลักนิติธรรมกับแนวทางการบริหารกิจการบ้านเมืองที่ดีหรือหลักธรรมาภิบาล (Good Governance) ว่ามีความเหมือนหรือแตกต่างกันอย่างไร แล้วนำข้อมูลที่ได้มาศึกษาเปรียบเทียบความคล้ายคลึงและแตกต่างของหลักต่าง ๆ ตลอดจนศึกษาประวัติความเป็นมา และการนำหลักต่าง ๆ มาปรับใช้ในกฎหมายต่าง ๆ โดยเฉพาะมาตรา 3 วรรคสองของรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550

This research attempted to compare related principles i.e., the Rule of Law, Legal State Principle, Rule of Law in Private Sector, and Good Governance in foreign contexts and to analyze the similarities and differences among these principles in order to create an integrated body of knowledge in this field, with an emphasis on the Rule of Law principle in the Common Law system countries which was concerned with the control of the use of power by the ruler under the law as well as the Legal State principle in the Civil Law system countries. In addition, this study also looked at the implementation of the Rule of Law and Good Governance, particularly in the light of the Constitution of the Kingdom of Thailand 2007, Article 3 second paragraph.
