ปัจจุบันกฎหมายที่คุ้มครองสิทธิของผู้สูงอายุโดยตรงคือ พระราชบัญญัติผู้สูงอายุ พ.ศ. 2546 แต่ บทบัญญัติดังกล่าวไม่ได้กล่าวถึงมาตรการในการคุ้มครองการจัดการทรัพย์สินของผู้สูงอายุแต่อย่างใด ทั้งเมื่อ พิจารณาจากกฎหมายที่ใกล้เคียงคือ ประมวลกฎหมายแพ่งและพาณิชย์ว่าด้วยเรื่องความสามารถของบุคคลใน การทำนิติกรรมเกี่ยวกับทรัพย์สินของคนหย่อนความสามารถตามกฎหมาย ได้แก่ ผู้เยาว์ คนวิกลจริต คนไร้ความสามารถ และคนเสมือนไร้ความสามารถ พบว่า ไม่ได้บัญญัติให้ความคุ้มครองในการทำนิติกรรมเกี่ยวกับ ทรัพย์สินของผู้สูงอายุไว้ก็โดยเฉพาะเช่นกัน ดังนั้น การกำหนดมาตรการทางกฎหมายไว้ในการตั้งผู้ปกครอง ทรัพย์สินของผู้สูงอายุในประมวลกฎหมายแพ่งและพาณิชย์จึงมีความจำเป็นเพื่อป้องกันไม่ให้ผู้สูงอายุต้อง สูญเสียทรัพย์สินของตนเองจากการถูกหลอกลวงด้วยรูปแบบต่างๆจากญาติพี่น้อง บุคคลที่ดูแลและพวก มิจฉาชีพ เป็นต้น ทั้งนี้ การตั้งผู้ปกครองทรัพย์สินที่จะกำหนดไว้ในประมวลกฎหมายแพ่งและพาณิชย์นั้นควร ประกอบด้วยสาระส าคัญ 6 ประการ ได้แก่ (1) ผู้ที่ได้รับการคุ้มครอง (2) ลักษณะการคุ้มครอง (3) ผู้มีสิทธิร้อง ขอตั้งผู้ปกครองทรัพย์สิน (4) คุณสมบัติและลักษณะต้องห้ามของผู้ปกครองทรัพย์สิน (5) อ านาจหน้าที่ของ ผู้ปกครองทรัพย์สิน และ (6) ความรับผิดและบทลงโทษของผู้ปกครองทรัพย์สิน

Nowadays, the law that directly protects the rights of the elderly is The Act on the Elderly B.E. 2546 (2003 A.D.). However, such law does not provide a legal measure to protect the management of the elderly’ assets. After examining the analogous laws which are the provisions in the Civil and Commercial Code regarding capacity of persons including minors, persons with unsound mind, incompetent persons, and quasi-incompetent persons to manage their assets, the research found that there is no legal provision directly enacted to govern juristic acts done by the elderly. Thus, including the legal measures with regard to the appointment of a guardian for the elderly to the Civil and Commercial Code is considered important in order to protect them from being deceived by their family members, those who are taking care of them, or frauds. The legal measures regarding the appointment of a guardian for the elderly in the Civil and Commercial Code shall consist of (1) persons who are entitled to the protection, (2) nature of protection, (3) persons who have the right to file the application of guardian, (4) characteristics of the guardian, (5) duties of the guardian, and (6) responsibilities and penalties of the guardian.
