บทบัญญัติโทษที่เหมาะสมสำหรับนักการเมืองที่ประพฤติทุจริต

Abstract

ปัญหาการทุจริตคอร์รัปชั่นของนักการเมืองในหน่วยงานของรัฐเป็นปัญหาที่มีความสำคัญ ซึ่งเป็นปัญหาที่มีมาอย่างช้านานแม้ว่ารัฐบาลทุกยุคทุกสมัยจะพัฒนาวิธีการป้องกันและปราบปรามการทุจริตเรื่อยมาแต่ก็ยังไม่ประสบความสำเร็จเท่าที่ควร วิทยานิพนธ์ฉบับนี้จึงศึกษาถึงปัญหากระบวนการทางกฎหมายในการต่อต้านการทุจริตคอร์รัปชั่นเกี่ยวกับการไม่ให้อำนาจเจ้าหน้าที่ในการดำเนินการเกี่ยวกับทรัพย์สินและเรียกทรัพย์สินที่ได้จากการทุจริตคอร์รัปชั่นของเจ้าหน้าที่ของรัฐคืนให้กับรัฐ ปัญหาเกี่ยวกับการลงโทษนักการเมืองที่ทุจริตคอร์รัปชั่น และ มาตรการทางกฎหมายที่เหมาะสมในการลงโทษนักการเมืองที่ทุจริตคอร์รัปชั่น โดยวิธีการศึกษาเปรียบเทียบกฎหมายภายในและกฎหมายต่างประเทศรวมถึงสัมภาษณ์เจาะลึกเพื่อประกอบการศึกษา ซึ่งผลการวิจัยพบว่า วิธีการดำเนินการแก้ไขปัญหาการทุจริตในหน่วยงานรัฐยังไม่มีประสิทธิภาพเท่าที่ควรและการก าหนดโทษที่มีอยู่ยังไม่มีความเหมาะสม

Corruption is significant and has long existed despite various but ineffective preventive and suppression measures imposed by many governments in the past. This thesis aims to study the problems regarding legal processes under the anti-corruption law. This law does not empower government officials to proceed against the property interests obtained from an act of corruption or the forfeiture of property arising out of those offenses by corrupt officials. The study was conducted by means of comparative study of domestic laws and foreign laws including in-depth interviews. The study found that the present anti-corruption practice in government agencies is ineffective and the existing offences are inadequate.
