Abstract

บทความชิ้นนี้ มีวัตถุประสงค์เพื่อทําความเข้าใจเบื้องต้นแนวความคิดสํานักกฎหมายธรรมชาติ และสํานักกฎหมายบ้านเมือง ที่ปรากฎหรือมีอิทธิพลต่อกฎหมายมหาชน ภายหลังการเกิดขึ้นของรัฐสมัยใหม่ โดยที่นําแนวคิดพื้นฐานของนักคิดบางท่านในแต่ละสํานักมาอธิบายและวิเคราะห์นักคิดในสํานักกฎหมายธรรมชาติ เช่น John Locke, Hugo Grotius, Montesquieu, Rousseau และนักคิดในสํานักกฎหมายบ้านเมือง เช่น Jean Bodin, Thomas Hobbes, John Austin นํามาศึกษาพิจารณาข้อความคิดที่มีอิทธิพลปรากฎก่อรูปก่อร่างเป็นแนวคิดกฎหมายมหาชนภายหลังการเกิดขึ้นของรัฐสมัยใหม่อย่างไรบ้าง

This article aims to describe the foundation of the concept of Natural Law and Legal Positivism that influence the development of public law after the establishment of modern state. The concepts of Natural law scholars such as John Locke, Hugo Grotius, Montesquieu, Jean Jacque Rousseau would be described and analyzed. Moreover, the concepts of legal positivism scholars such as Jean Bodin, Thomas Hobbes, John Austin would be described and analyzed. The analysis of this article would focus on “How the mentioned concepts influence the evolution of public law after the establishment of modern state?”
