Abstract
ภายใต้บริบทที่การค้าด้านบริการของภูมิภาคอาเซียนเติบโตและพัฒนาถึงขีดสุด ประกอบกับปัจจัย ภายในทางสังคมของประเทศไทยและปัจจัยภายนอก คือ ทิศทางแนวโน้มในการเปิดเสรีการค้าบริการด้าน วิศวกรรมโลกและการขยายการค้าและการลงทุนตามนโยบายหนึ่งแถบหนึ่งเส้นทาง (One-Belt OneRoad—OBOR) สู่ภูมิภาคเอเชียตะวันออกเฉียงใต้ของจีน มีความเป็นไปได้สูงที่ประเทศไทยจะประสบ ปัญหาการขาดแคลนวิศวกรและธุรกิจงานบริการวิศวกรรมในอนาคตอันใกล้ โดยมีแนวโน้มที่จะขาดแคลนวิศวกรมีฝีมือแม้จะมีการเพิ่มขึ้นของจำนวนสถาบันการศึกษาที่เปิดการเรียนการสอนในสาขาวิชาวิศวกรรมศาสตร์ที่ควรส่งผลในเชิงบวกต่อปัญหาการขาดแคลนแรงงานก็ตาม ในขณะที่การเปิดเสรีด้านวิศวกรรมอาเซียนก็จะส่งผลให้มีการไหลออกของแรงงานวิศวกรจากประเทศไทยมากขึ้นไปด้วย

ดังนี้ผลกระทบที่ประเทศไทยอาจได้รับอย่างหลีกเลี่ยงไม่ได้คือการขาดองคาพยพในการพัฒนาต่อยอดโครงสร้างด้านการค้าและการลงทุนพื้นฐานในภาคเศรษฐกิจอันเป็นฐานสำหรับการผลิตสินค้าและบริการที่มีความจำเป็นต่อประเทศ ส่งผลให้ประเทศไทยขาดความพร้อมในการรองรับการเติบโตทางเศรษฐกิจในภูมิภาคต่อไป

จากผลการศึกษาวิจัยพบว่า บทบัญญัติในทางระหว่างประเทศว่าด้วยการเปิดเสรีด้านการค้าบริการ ในสาขางานวิศวกรรมตามกรอบอาเซียนของไทยและกฎหมายภายในของไทยในปัจจุบันไม่สอดคล้องกับ สภาพสังคมและเศรษฐกิจของประเทศและของภูมิภาค อีกทั้งมีการกำหนดข้อผูกพันในลักษณะเป็นการ ปกป้องตลาดวิศวกรรมภายในหากเปรียบเทียบกับบทบัญญัติในทางระหว่างประเทศว่าด้วยการเปิดเสรีด้าน การค้าบริการในสาขางานวิศวกรรมตามกรอบอาเซียนของประเทศมาเลเซีย โดยบทบัญญัติในทางระหว่าง ประเทศของประเทศไทยมีความคล้ายกันของเนื้อหากับกรอบข้อตกลงระหว่างประเทศว่าด้วยงานบริการ วิศวกรรมอื่นที่ประเทศไทยเคยทำแทบทั้งหมดแม้จะจัดทำในช่วงเวลาที่แตกต่างกัน อีกทั้งยังขาดการบูรณาการและไม่นำพาต่อแนวโน้มในการเปิดเสรีการค้างานบริการโลก

ประเทศไทยจึงมีความจำเป็นอย่างเร่งด่วนในการพิจารณาแก้ไขกฎหมายภายในพร้อมวางกรอบยุทธศาสตร์ในการเปิดเสรีงานบริการวิศวกรรมอย่างเป็นระบบ โดยรัฐสมควรกำหนดเป้าหมายในการขับเคลื่อนประเทศให้ชัดเจน พร้อมประสานงานกับหน่วยงานที่เกี่ยวข้อง (อาทิ สภาวิศวกร) เพื่อการบูรณาการในการทำงาน ดำเนินการเชิงรุกในสาขางานวิศวกรรมที่ประเทศไทยมีจุดแข็ง (อาทิ วิศวกรรมโยธา) และดำเนินนโยบายเชิงปกป้องบางส่วนโดยเปิดเสรีอย่างค่อยเป็นค่อยไปด้วยความสมัครใจในสาขางานวิศวกรรม ที่ประเทศไทยยังไม่พร้อมที่จะแข่งขันหรือที่มีความจำเป็นจะต้องควบคุมความปลอดภัยหากมีการเปิดเสรีเนื่องจากคุณภาพและมาตรฐานของวิศวกรรมจากต่างประเทศ ทั้งนี้โดยพิจารณาถึงการสร้างความสมดุลระหว่าง 1) ประโยชน์ที่ประเทศไทยจะพึงได้รับจากการนำเข้าวิศวกรต่างชาติหรือองค์กรธุรกิจผู้ให้บริการวิศวกรรมต่างชาติและ 2) มาตรการที่สมควร/จำเป็นเพื่อควบคุมให้เป็นไปตามมาตรฐานวิชาชีพและมาตรฐานด้านความปลอดภัย ตลอดจนมาตรการในการส่งเสริมและพัฒนาขีดความสามารถของผู้ให้บริการ ชาวไทยให้พัฒนาไปพร้อมกันกับระดับของการเปิดเสรีดังกรณีศึกษาของประเทศมาเลเซียเป็นสำคัญ ทั้งนี้ เพื่อใช้ประโยชน์จากการถ่ายทอดองค์ความรู้ เทคโนโลยี ตลอดจนนวัตกรรมสมัยใหม่ ลดปัญหาการขาด แคลนแรงงานด้านวิศวกรรมในประเทศ และเพิ่มขีดความสามารถของอุตสาหกรรมวิศวกรรมภายในเพื่อ พัฒนาศักยภาพในการแข่งขันของไทยที่จะส่งผลต่อการพัฒนาเศรษฐกิจของประเทศอย่างยั่งยืนในอนาคต

It is highly likely that Thailand will face a shortfall of engineers and experience challenges in the domestic engineering service sector soon for a number of reasons. First, ASEAN trade in services is at the apex of growth and development. Second, internal social factors in Thailand have hindered the development of qualified engineers. Third, Thailand has been impacted by external factors such as the global trends of liberalization of trade in engineering services and the penetration of trade and investment by the People’s Republic of China’s One-Belt, One-Road Initiative in Southeast Asia. Despite increasing numbers of higher education institutions offering degrees in engineering, which should in theory, have a positive effect on the shortfall, the main problem is not the quantity but rather the quality of the graduates. Furthermore, ASEAN liberalization of trade in engineering services will accelerate the “brain drain” of Thai engineers.

Thus, an inevitable effect that Thailand will likely encounter is the lack of a body of knowledge that can develop and advance trade and investment in the engineering sector. This body of knowledge is essential to the fundamentalsof producing goods and providing services, which are indispensable to an economy. The lack of such a body of knowledge will preventThailand from being ready to uphold and meet the region’s economic growth.

The research found that Thailand’s commitments under the ASEAN framework on liberalization of trade in engineering services and Thailand’s current domestic laws are inconsistent and incompatible with society and economics at boththenational and regional level. The research also found that Thailand applies protectionism commitments (when compared with those provided by Malaysia). Such commitments are stipulated almost in the same manner across all other international liberalization of trade in engineering services frameworks, although they were agreed at different periods. The research also found that these commitments lack an integrated character and do not take into consideration the global trends of liberalization of the trade in services

Hence, the research suggests that Thailand urgently needs to amend its domestic laws and draw strategic frameworks to systematically liberalize its engineering services sector. In this regard, the government should set clear goals for action. This should be done proactively with the departments concerned in order to apply an integrated approach to the engineering service sector, which Thailand can do particularly well. The research also recommends that the government maintain a partial protectionism policy, by gradually liberalizing those portions of the engineering sectors that on a voluntary basis that Thailand is not entirely ready to liberalize, or where the quality of foreign engineers presents safety concerns and hence should be controlled. This should take into account the balance between 1) the benefits that Thailand will enjoy from allowing the entry of foreign engineers or foreign businesses that provide engineering services, and 2) measures that are necessary and appropriate for quality control and the maintenance of professional and safety standards, as well as measures to encourage and develop Thai service providers’ capabilities to meet the level of liberalization, as in Malaysia. This is to be carried out in order to maximize the benefits of knowledge and technology transfer and innovation. The aim should also be to decrease the shortfall of qualified engineers and increase the capabilities of the domestic engineering sector to improve its competitiveness in the global market, which will, in turn, shape Thailand’s sustainable economic development for the future.
